Ms. Sangita Honmane for defendant/MCGM is present. She filed pursis of intimation. Taken on record. It is marked as Exhibit 4. O- Seen. Ld Adv for defendant/MCGM intimated through above pursis that the plaintiff himself has removed the notice structure and complied the Order. According to her now remains nothing in the suit. I have perused aforesaid pursis along-with letter of AE, M-West annexed with photograph. In view of said pursis I proceed to pass Order Below Exhibit 1. Order below Exhibit 1: Perused pursis below Exhibit 3, document annexed thereto. It appears that the plaintiff was cited with notice U/s 354-A of MMC Act. As per said notice, as of now the notice structure has been removed by the notice bearer ie plaintiff. Photograph of suit structure after removal of notice structure are annexed herewith the pursis. As the notice structure is being removed by the plaintiff himself, nothing survives in the suit as it become infructuous. Hence, the Order. ORDER 01. Suit is dismissed U/s. 151 of the Code of Civil Procedure 1908, as it has become infructuous. 02. The plaintiff to bear costs of this suit. Bill of costs be drawn-up accordingly. 03. The Original documents, if any, filed on record be returned to the respective parties, on their submitting its Certified Copies, if the documents are exhibited, or Self-attested True Copies, if the documents are not exhibited, along-with undertaking to furnish the originals as and when required by the Court.
