Today the plaintiff and defendant no. 2 who are present along with
their respective advocates have admitted the contents in the consent
terms along with their respective signatures on it. After explaning the
contents in the consent terms, this court is satisfied that the plaintiff
and defendant no. 2 voluntarily entered into the consent terms. The
defendant no. 1 is absent since beginning and the suit also proceeded
without w.s. against defendant no. 1. The defendant no. 3 appears to be
a formal party and defendant no. 5 is the owner of the tenanted
premises. Therefore, having regard to the nature of dispute, relief
sought in the suit and the terms of compromise, consent terms is duly
accepted and read and recorded.
In view of the consent terms Exh. 4 duly read and recorded, the
plaintiff withdraw the suit unconditionally in view of aforesaid
settlement.
Hence, suit stands disposed off for want of prosecution.
Accordingly L. C. Suit No. 3554 of 2013 stands disposed off.
In view of disposal of the suit, Notice of motion no. 1419/2018 also
stands disposed off for want of prosecution.
