to say. The present suit is for injunction against defendants that
they should not disposses the plaintiff from the suit property
without following due process of law. However Suit No.
5278/2024 is filed by the defendants of this suit against the
plaintiff for the recovery of possession of suit property. The
defendant No.1 and 2 have not taken objection for allowing the
withdrawal of suit. In view of this I do not find anything
contrary so the permission for withdrawal of suit deserves to
be granted, accordingly following order is passed Order 1.
Application Exh.9 is allowed as prayed. 2. Suit No.1529/2019
is hereby withdrawn cum dismissed for want of prosecution. 3.
No order as to costs. 4. Bill of costs be drawn accordingly.
