3 Both the suits being counter suits, in order to avoid findings
by two different courts, they are brought together in one court to be
heard and decided as per law. Hence, I pass following order:

1) T.A. 91/18 is allowed.
2) S.C. Suit No.185/13 (presently in C.R. No.2), is withdrawn
and is transferred to C.R.No.1.
