This is a notice of motion filed by defendants to accept
written statement.
2. Perused reply submitted by plaintiff.
3. Heard, learned advocate Mr. Nuniwal for defendants at
sufficient length. Learned advocate Mr. Ware for plaintiff requested to
note that there is delay of 400 days and no documentary evidence is
filed to explain delay caused.
4. This is a suit for recovery of amount i.e 5,79,305/. There
are sufficient grounds mentioned for delay caused.

5. Perused Medical case paper of Wadia Hospital. It will be
judicious to decide the matter on merit.
Hence, the order
ORDER
1. Notice of Motion No.1625 of 2019 is allowed, subject to cost of
rupees 3000/ be paid to plaintiff on or before next date.
2. After payment of cost the Written Statement of defendants be
accepted.
3. The Notice of Motion No.1625 of 2019 disposed of accordingly.
