O R A L O R D E R
The plaintiff took out the present Notice of Motion to set
aside the order dated 10th August,2017 dismissing the suit for want of
prosecution.
2 Heard both the sides. Perused the record.
3 It appears that the plaintiff and his counsel were diligent in
prosecuting the present suit. However, for 34 dates as the presiding
officer was busy in some other work, there were adjournments and
thereafter the matter was transferred to this court.

4 The plaintiff claims to be unknown about the fact of the
transfer. I am inclined to restore the suit by condoning delay in filing
this application, however, subject to costs of Rs.2,000/ to be paid to
the defendants. Hence, I pass the following order:
O R D E R
Notice of Motion No.1389/18 is made absolute
subject to costs of Rs.2,000/ to be paid to the
defendants.
