Plff adv.submitted that defendant\''s adv.not continued with cross examination and court commissioner is also admitted that document filed by defendant no.1 were lost. In such circumstances considering the submission I find that it will be better the court itself should record further evidence in the matter however, the suit is filed in 2018. Court is over burden and old suits of 1973 onwards are pending before this court and it is the duty of this court to give priority for disposal of the suit which are pending more than 5years, 7 years, 10 years or more. In such circumstances, court accepts cooperation from the parties and it is made clear that further evidence will be recorded by this court in the month of August.
Plaintiff\''s adv. submitted that till the objection raised at the time of cross examination before Court Commissioner are decided certified copy of Commissioner\''s report should not be given to any of the parties. However, defendant\''s adv. submitted that already certified copies of Commissioner\''s report is obtained by defendant.
