O R D E R
1. This Chamber Summons is filed to condone delay of 63 days in
filing leave to defend. Defendant has stated that he has filed a
complaint to Kala Chowki Police Station against plaintiff for forgery of
Promissory Note. Defendant has further stated that he, his wife were
working individuals and therefore, there were not able to visit the office
of the Advocate and give instructions and documents to the Advocate
required for filing of leave to defend cum reply.
2. Plaintiff has replied that order be passed subject of cost. It
appears the delay on the part of defendant is not intentional. But at the
same time due to delay of defendant, plaintiff should not suffer.

Therefore, Chamber Summons needs to be allowed subject to cost.
Hence, following Order:
ORDER
1. Chamber Summons in Summary Suit No.558/2018 is allowed,
subject to cost of Rs.1,000/ to be given by defendant to plaintiff.
2. Chamber Summons in Summary Suit No.558/2018 stands disposed
of.
