1. By instant Chamber Summons, the plaintiffs have
requested the Court to permit them to add name of Miss Geeta
Tribhovandas Canabar as defendant no.6 by deleting the present
defendant no.6 KPMG India, Lodha Excelus, and other consequential
contentions about said party. Despite opportunity the defendant nos.
1 to 5 and 7 have not filed reply to the said Chamber Summons.
The matter has not reached stage of Recording of Evidence. No
prejudice will be caused to the defendants if the amendment is
allowed. Therefore, Chamber Summons No.556 of 2020 is allowed as
prayed. Hence, following order:
ORDER
1. Chamber Summons No.556 of 2020 is allowed as prayed
2. The necessary amendment be carried out in the plaint accordingly
on or before next date.
3. After such amendment is carried out by plaintiffs, writ of summons
be issued to proposed defendant nos. 6 Miss Geeta Tribhovandas
Canabar.
