Business : Matter is called out at 3.56pm Adv.Jaywant for
defendant no.3 present. Adv.Ms.Sukeshi Bhandari
for plaintiff present. Adv.Bafna a/w Adv.Patel for
defendant no.1 and 2 present made specific
statement they are not representing defendant
no.4. Plaintiff point out that the reply to N/M filed
by them also appears to be filed on behalf of
defendant no.4. In view of the statement made by
the advocate Bafna and Patel that it was
typographical mistake they are allowed to correct
the same forthwith. Heard both the side on N/m
No.1359/18. Adv.Jaywant for defendant no.3
made a specific statement that, defendant no.3 is
in possession of residential room A/405, Siddhant
Building G.D.Ambedkar Parel, Mumbai which is
described in schedule of properties Exh-A of plaint
at Sr.No.II. They have made a statement during
pendancy of present suit they are not going to
third party interested in the same. Adv.Patel for
defendant no.1 and 2 made similar statement in
respect of Room No.B/216, Siddhant Building
G.D.Ambedkar Parel, Mumbai and one commercial
premises situated at Dabholkar wadi, A-ward, SRA
Sakari Gruhnirman Sansatha E-Wing 1st floor
Parel, Bhoiwada thus, acccepting the statement
made by the advocates of respective parties upon
instructions the N/M No.1359/18 can be disposed
off. The statement is excepted. N/M No.1359/18 is
disposed off accordingly.
