O- Heard both the sides. Having considered their submissions, at the outset, it is clear that even after affording of the ample opportunities, the plaintiff remained absent to proceed with the NM. Time and again, he was directed and was informed that in case of his failure, the suitable order would follow, but all in vain. It seems that after securing some interim order in his favour, now, the plaintiff is interested to go on trial. Even today, while filing this application the plaintiff is not ready with his submissions on NM. He could have shown his bonafide to go on trial by filing the submissions on record. However, again he failed in the said cause. The matter is more than 5 years old and its progrees is hampered mainly because of the plaintiff\''s absence. In the circumstances, the NM is posted for dismissal Order and the interim order is not continued. Now, it seems that the defendant is proposing some action against the notice structure and therefore, the plaintiff is before this Court. Certainly, the plaintiff did not timely proceed and therefore, he does not deserve for any equity. At this juncture, Shri. Nilesh Pandey Advocate for the plaintiff personally undertook to file submissions on NM and to proceed with the matter on the next date. He submitted that if the suit structure is demolished, the very purpose of filing this suit would be infrcutous. Taking into account his personal undertaking and the fact that since last considerable time, interim order existed in favour of the plaintiff, the same is continued strictly till the next date, subject to payment of costs of Rs.5,000/- to be deposited with the concerned Office of the defendant. The plaintiff is directed to submit compliance of this Order and to file his written submissions on NM on the next date. In default, the NM would stand dismissed for want of prosecution.
