Perused the Notice of Motion which is supported by an affidavit being executed by Defendant Dhaval Shaha. Heard Adv. Rajesh Ghag for the defendant and Adv. Sujata Natekar for the plaintiff. In the application it is submitted that there is eleven days of delay in filing reply to summons for judgment. As per the record the summons for judgment was received by the Adv. for defendant on 14.12.2020 by RPAD and the tenth day was 24.12.2020 that is prior to Christmas vacation. I find substance in the argument advanced by the Ld. Adv. that if vacation period is excluded then practically there is only one day delay. This application is for condoning eleven days of delay. Considering, the Covid -19 pandemic situation and the contents of Para no. 2 to 4 of the affidavit in support of the NM, I am satisfied that the defendant has explained the said delay and it can very well be condoned in the interest of Justice.
Hence, I pass the following order-
ORDER
NM no. 78/21 is allowed and made absolute in terms of prayer clause (a) and (b) subject to defendant filing the affidavit in reply to the summons for judgment today itself and also supply the copy to the plaintiff.
