09/03/2021, adv. For plaintiff tendered application for
withdrawal of the suit. Since then, plaintiff and his advocare
are absent. From the perusal of the withdrawal application,
it appears that, plaintiff has not sought any liberty and as
such the plaintiff is praying for unconditional withdrawal of
the suit. Plaintiff is the master of his suit. Therefore, it will
be appropriate to allow the application for withdrawal of
suit. Hence, application for withdrawal of suit is allowed
and plaintiff is permitted to withdraw the suit
unconditionally. In view of the order permitting plaintiff to
withdraw the suit unconditionally and considering the
absence of plaintiff since long, it will be appropriate to
dispose off the the suit as withdrawn unconditionally.
Hence, suit is disposed off as withdrawn unconditionally. As
the suit is disposed off, NM no. 1588/19 does not survive.
Therefore, NM no. 1588/19 is also disposed off as filed.
