Perused plaint, documents annexed thereto, Notice of Motion, affidavit on behalf of defendants no.1 to 3 and heard both sides. The plaintiff has prayed for temporary injunction restraining the defendants from creating third party rights over the suit premises and directing the defendants to file affidavit stating their known/unknown movable and immovable properties. With regard to the prayer clause (b) i.e. second prayer, the same can be considered after filing reply by the defendants and hearing both sides on merits.
With regard to the first prayer for temporary injunction, defendants have filed affidavit stating that they have sold the suit premises to Vinayak Govin Lahot on 01.02.2020. In view of this submission, the ad-interim relief sought by the plaintiff in terms of prayer clause (a) has also become redundant. For the reasons given above, prayer for ad-interim reliefs is rejected and following order -
