1. The representative of plaintiff and defendant No. 3 and 4
filed consent terms below Exh. 9. The plaintiff and defendant
No. 3 and 4 admitted signature and contents. They are
identified by respective Advocates. The plaintiff and D-3 and
4 submitted that in view of consent terms plaintiff is
withdrawing the suit and accordingly suit be disposed of.
2. Deft No. 1 and 2 and Deft No. 5 submitted to pass
necessary order. Plaintiff submitted that by removing wall we
have restored position as per sanctioned plan. Therefore in
view of pursis below Exh.9, suit is disposed of as withdrawn.
Hence I pass following order.
ORDER
1. Suit is disposed of as withdrawn in pursuant to consent
term below Exh. 9
2. In view of disposal of suit NM No. 2189/2023, NM
2377/23 are disposed of accordingly.
