The defendant has not filed reply to CS despite grant of time on 6.4.2018. There is no appearance on behalf of defendant since June 2014. The present chamber summons is filed by plaintiff for adding the respondent - Sarvesh Enterprises as defendant no.2 to the suit. It is pointed out that the proposed D-2 is developing the suit property. A perusal of the schedule of proposed amendment shows that plaintiff wants to bring on record the subsequent developments that have occurred during the pendency of the suit and consequential prayer. The proposed amendment does not change the nature of the suit in any manner. Hence chamber summons no.614 of 2018 is allowed. Necessary amendment be carried out within two weeks.
Plaintiff is directed to provide the fresh typed amended copy of the plaint to court till next date with copy to other side.
