Heard Ld. Counsel for plaintiff in CS No.608/2018.
This chamber summons is filed by plaintiff to bring on record the
LRS of D-2 who expired on 15.1.2018. It is filed within time. Hence
chamber summons no.608/2018 is made absolute in terms of prayer
clause (a) only. Necessary amendment be carried out within two
weeks.
Ld. Counsel for plaintiff filed draft chamber summons along with
affidavit of service, praying for substituted service. z
Heard Ld. Counsel for plaintiff in draft chamber summons.
Ld. Counsel for plaintiff has pointed out the original envelops of
proposed legal representatives of D-18 which show that they are not
served and the envelope shows the remark 'left'. Hence plaintiff is
praying for service through paper publication. Ld. Counsel for
plaintiff submits that the paper publication will be carried out in
newspapers namely 'Navshakti' and ' Free Press Journal'. Hence draft
chamber summons allowed. It be registered for statistical purpose.
Ld. Counsel for plaintiff is directed to file amended copy of the plaint
in the court with copy to the other side by next date.
