By this chamber summons, the plaintiff is seeking permission to
amend the plaint in view of death of D-1 who expired on
21.10.2017.
Since one of the legal representative of deceased D-1 Pramod Joshi
is already on record as D-2, the chamber summons is filed within
time. When one of the legal representative is on record, the
limitation to bring the other legal representatives is 3 years as per
the law laid down by Hon'ble Bombay High Court. Hence chamber
summons no.600/2018 is made absolute in terms of prayer clauses
(a) and (b). Necessary amendment be carried out as per the
schedule clauses (I) to (III) within two weeks. Clause(IV) is not
permitted.
Amended copy of the plaint be filed in the court with copy to the
other side.
