ORDER
This is a chamber summons preferred by plaintiff to carry
out amendment in plaint. Perused reply submitted by MCGM.
2. Ld. Adv. V.T.Dubey for plaintiff submits that during
pendency of the suit, the speaking order dated 08/09/2020 came to be
issued by the MCGM. Therefore, it require to incorporate in the plaint.

3. Ld. Adv. Tondwalkar for defendant / MCGM submits that it
is premature suit. It was expected on the part of plaintiff to wait till
issuance of speaking order. It is submitted that plaintiff is intending to
fill up lacunas. It is claimed to reject the chamber summons.
4. There is substance in the submission of ld. Adv. for MCGM,
however plaintiff was in fear that even prior to issuance of speaking
order, defendant may demolish the notice structure. As soon as the
plaintiff has received the copy of the speaking order, he approached this
Court to incorporate the said order being subsequent event. Obviously,
it will not change the nature of the suit. Hence it is allowed and
following order is passed :
- ORDER -
1. Chamber Summons No. 539/2020 is allowed.
2. Plaintiff to carry out the amendment within two weeks
from today.
3. Ch/s No. 539/2020 stands disposed off.
