Whether the plaintiff has right or interest over such flat is matter of adjudication. In such case if chamber summons is allowed to amend the plaint so as to change address of the plaintiff, defendant No. 1 and replace pleadings of the plaintiff in plaint para No. 3 and prayer vide clause 27 (a), 27 (b) and 27 (c) no prejudice will cause to defendants. Thus, chamber summons is allowed in terms of prayer clause (a) and (b). The plaintiff to carry out necessary amendment within 14 days and file amended plaint on record. Accordingly Chamber Summons No. 876/2023 stands disposed of.
Defendant No. 5 though filed pursis at Exh. 4 failed to file Written Statement hence, its right to file Written Statement is hereby forfeited. affidavit of service referred by plaintiff's advocate vide pursis at Exh.3 is now marked as Exh.5. Both parties are directed to file draft issues.
