clause no. 4 in the application, I would like to mention that the
court had raised issue of maintainability of second Ch/s for
seeking amendment in the earlier Ch/s. As today the plffs are
taking out new Ch/s by withdrawing earlier two Ch/s that too
in respect of adding proposed deft no. 2 as a party, in the
interest of justice, present application is allowed and all rights
and contentions of the proposed deft to challenge
maintainability of the Ch/s and to challenge Ch/s on other
grounds, has kept open for its decision on merits. Thus,
application (exh. 30) is allowed. Draft Chamber Summons
alongwith affidavit in support taken out by the plaintiff for
t.o.r. Leave granted to register. Matter is adjd. to 3.10.2018 for
reply to Ch/s
