1. Plaintiff has taken out this Chamber summons for
replacement of Tattva Mittal and Mittal Lifespaces Pvt. Ltd as
defendant no 2.
2 I have perused the Chamber Summons. It is contended that
the developer is Tattva Mittal and Mittal Lifespaces Pvt. Ltd. However.
due to inadvertently the name of defendant no 2 is written as Mittal
Builders. Hence prayed to allow the chamber summons.
3 Heard both the sides.
4 Amendment is necessary for determination of controversy
between the parties. The proper party is necessary to come on record.
Hence following order is passed:
ORDER
1 Chamber Summons No 584 of 2018 is hereby
allowed.
2 Tattva Mittal and Mittal Lifespaces Pvt. Ltd is hereby
replaced in place of defendant no 2 Mittal Builders.
