Exh. 9 Consent terms executed between the parties before the Mediator. It is
submitted by the parties that though consent terms revealed that the agreed amount
was to be paid on or before 28.06.2019, the deft has already made the payment of
such amount and the plff has received the amount by RTGS and therefore, any
compliance is not remained to be performed by either of the parties under the
consent terms. Exh. 10 Joint pursis alongwith document filed by both the parties.
Entry of joint pursis Exh. 10 as the compliance of consent terms is already effected
and accepted by parties, any further compromise decree in terms of consent terms is
not essential. Hence, the order as follows. ORDER 1. The suit is disposed of as
settled between the parties as per the consent terms Exh. 9. 2. Necessary refund of
court fees be made as per the rules. 3. No order as to cost.
