The following Order is passed on Contempt NM No. 1837/2021:
01.     Considering the written submissions of the plaintiff on this NM and the record, it is worth notable that this NM is filed under O. XXXIX Rule 2-A of the C.P.C., 1908, to initiate a contempt action against the defendants for having committed a willful breach of this Court’s Order dtd. 06.10.2020 and also to punish them by sending behind the bars, along-with other reliefs. As such, trying of this NM, with the suit, would surely delay this trial, specially when the set of evidence, which might be led in this NM, would be different and it would be nothing to do with the suit. Hence, in view of the ratio laid in case of Rampyaribai Sukhdeo Daga V. Niladevo Narayandas Jakhotiya, 2007 (4) Mh.L.J. 213, it would be just to separate this NM and to get registered as an independent proceeding. Therefore, without recording finding on its merits, NM No. 1837/2021 stands disposed of as not triable, with this suit. The plaintiff is placed at absolute liberty to file separate Miscellaneous Judicial Case about the Contempt, if he so desires.
