Advocate of plaintiff filed affidavit of service upon the defendants. The advocate of plaintiff submitted that the plaintiff had entered into a leave and license agreement with the defendant no. 2 and 3 till 15.12.2020 and he was paying the license fee regularly. He also relied upon the NOC granted by the defendant no. 1 in favour of the plaintiff. He thus submitted that when the lock in period of 18th months was a operation the defendants could not restrain the plaintiff from entering the suit premises.
The Ld. advocate of the defendant no. 1 submitted that the plaintiff was not duly following the conditions mentioned in the NOC and thus the NOC could be declared null and void. He brought to my notice the entires showing that the guest occupying/ visiting the suit premises were not mentioned in their list given to the defendants.
