sought permission to withdraw the suit vide Exh.3 in
addition to that plaintiff and defendant no.2 have filed
consent terms on record wherein it is stated that the
defendants have drawn demand draft of Rs.4,20,000/- on
RBL Bank bearing no.393574 and handed over the same to
the plaintiff. Plaintiff Mahesh Salvi is appearing before the
Court and identified by his Lrd advocate. He admits the
receipt of demand draft as aforesaid. He says that he need to
withdraw the suit. Hence, plaintiff is permitted to withdraw
the suit subject to prejudice to the rights of legal hairs to
defendant no.1 No order as to cost. Court fee be refunded to
the plaintiff if any as per rules to be disposed of
accordingly. SJ is accordingly disposed of.
