Perused the notice of motion which is supported by an affidavit of defendant Gaurav Goyal. Also perused the reply on affidavit being executed by Sapon Chakravorty. Heard. The returnable date for writ of summons was 17.11.2020 and the defendant has to file vakaltnama or appearance till 28.11.2020 as this was the suit under Order 37 of the CPC. The period during which the returnable date was a period of lock down due to the pandemic. The Court has started functioning regularly from February. Considering these circumstances I am of the opinion that for giving fair opportunity to the defendant, the appearance/ vakaltanama can be very well taken on record by condoning the delay.
