plaintiff
The Ld. counsel for the plaintiff filed an application for
withdrawal of the suit conditionally, as the defendant have agreed
to settle the dispute amicably out of court, with liberty to file a
fresh suit on the same cause of action, if the matter is not settled
as agreed by the defendant.
The defendant is served with the copy of this application by
registered court as per the copy of the track record but no one is
present for the defendant.
In view of the above, the application for withdrawal at Exh. 3 is
allowed, with liberty to fresh suit on the same cause of action.
The suit and draft NM are disposed of as withdrawn.
The suit as well as draft NM shall be registered for statistical
purpose.
