present. When called repeatedly neither plaintiff nor his
advocate present till 12.15 PM. The suit is instituted on
22.03.2018 for declaration, partition. The suit proceed
without Written Statement on 25.10.2023 since then matter
was fixed for evidence. The plaintiff has not adduced
evidence therefore on 20.08.2024 suit was fixed for
dismissal. Subsequent to it on many occasion it was kept
before Lok-adalat by issuing notice to both parties but none
appeared. Therefore on 15.03.2025, 09.01.2026 suit again
fixed for dismissal order. However, the plaintiff has not
taken any steps today also none present for plaintiff. After 8
years the suit is pending for evidence of plaintiff and then
for steps. It is pending since last more than 8 years. There is
no progress in suit, no purpose will serve by keeping the
matter pending without any progress. The conduct of
plaintiff shows that he lost interest in the litigation. The
plaintiff is not interested in prosecuting the suit. Hence the
Suit No. 3363 of 2018 is dismissed for want of prosecution
and necessary steps. No order as to costs. Notice of Motion,
Chamber Summons if any, disposed of as infructuous.
