This Chamber summons is taken out by the plaintiff for the amendment in the plaint. The defendant resisted it by filing reply at Exh.3. Heard learned advocate for the plaintiff and the learned advocate for the defendant. Due to death of the original plaintiff, the applicants want to implead themselves as legal heirs/plaintiff to the suit. The original plaintiff has expired on 16.01.2021. Copy of death certificate Exh.A is on record. Considering the nature of dispute, legal heirs of the deceased plaintiff are required to be taken on record. Hence, I pass following order.
