By way of present Ch/s, applicant (ori. defendant No.05) wants to bring on record the legal heirs of JD No.1 who died on 04.07.2021. By filing reply overleaf, Adv.          By this application the applicant (Ori. Defn. No.5) is praying for police protection to take possession of flat No.2/101, Saitej CHS, Dainik Shivneri Marg, Gandhi Nagar, Worli, Mumbai-400018 through bailiff. Heard Adv. Pawar for applicant and want to the entire documents file on record. Suit No.4137/2010 (H.C. Suit No.2020/2010) was filed by Baby Yallappa Bamne against defendants for partician of the flat. The suit was decreed on 14.02.2017. Though no any share was given to defendant No.1 and 2, however, they were entitled to received share of Bhirwarabai on the basis of Will on probate. If not probated then the share will go to the heirs of late Hindurao. Thereafter, E.A.113/2019 was filed by plaintiff/ DH. The consent terms were filed by plaintiff and defendant No.3 to 6 wherein the present applicant (Ori. Defn. No.5) purchased the shares of the remaining plaintiff and defendant No.3, 4 and 6 by paying Rs.7,40,000/- each. In view of the consent terms the E.A. was disposed of. The record further reveals that the Registrar, City Civil Court issued Certificate of Sale and it was registered with the Registrar of Assurance. However, when the bailiff visited the premises it was found in possession of defendant No.1 and 2.
            The defendant No.1 and 2 failed to produce any Will or Probate, therefore they have no any share in the suit flat. As the plaintiff and defendant No.3,4 and 6 are already paid, it is the applicant (Ori. Defn. No.5) who is entitled for the entire share of the suit flat. As it is in possesion of defendant No.1 and 2 and in view of the objection by them of refusing to handover the possession, hence, I am of the view that Police protection prayed is necessary to be granted to take possession of the suit flat. In the result I proceed to pass the following order.
ORDER
1. The application Exh.4 is allowed as prayed.
2. The Senior Police Inspector of Worli police station is directed to depute two male and two female police constables to help the bailiff in securing the possesion of  flat No.2/101, Saitej CHS, Dainik Shivneri Marg, Gandhi Nagar, Worli, Mumbai-400018 as per the date fixed by the Sheriff Mumbai.
3. The applicant to deposit necessary charges with execution department.
