Today plaintiff filed application for withdrawal of suit by submitting that in view of Deed of Declaration cum indemnity dtd.03.12.2019 executed by defendant no.2, plaintiff does not want to proceed with the suit and hence he be allowed to withdraw the suit unconditionally. Power of Attorney holder of plaintiff is present. He admitted the contents of application. Application is signed by Power of attorney holder and his advocate. Defendants failed to appear and file say. It appears that plaintiff does not want to proceed with the suit. Since, plaintiff is withdrawing the suit unconditionally, permission is granted to withdraw the suit. In the result following order is passed.
