Defendant filed reply to chambers summons No.100952/2025.
Heard both the sides.
Through said chamber summons, the plaintiff has sought permission to
carry out amendment in the plaint, regarding interest from 18% to 9%.
Through overleaf reply, the defendant has objected the chamber
summons.
Considering the technical nature of the amendment and further
considering that the parties will be having an opportunity to raise their
contentions at appropriate time, the amendment deserves to be allowed,
but with costs. Hence, follwoing order -
ORDER
1. Chamber Summons No. 100952 of 2025, is allowed subject
to costs of Rs.1,000/- to be paid to defendant.
2. By next date, plaintiff shall carry out necessary amendment,
shall file copy of amended plaint and shall supply copy of
amended Plaint to defendants.
3. If plaintiff fails to comply the Order by next date, then the
Suit shall proceed further.
4. Order dictated and pronounced in Open Court in presence
of aforesaid lawyers.
5. Record of Chamber Summons No. 100952 / 2025 shall be
part of Summary Suit No. 100485 / 2018.
Parties to take appropriate steps by next date.
Suit adjourned to 21.04.2025 for compliance/summons for
judgment hearing.
