: ORDER :
This Notice of Motion is taken out by defendants no. 1 and 3
for setting aside no cross order passed by this court on 14.08.2017.
2. Defendants submitted that on 22.09.2017 the counsel was
present before the court and the matter was adjourned to 24.11.2017.
But when they appeared on 24.11.2017 they were informed that no
cross order was passed on 14.08.2017. Thereafter settlement talks were
going on, but they could not materialized. They submitted that the
delay was not deliberate and prayed to setaside the impugned order.
3. The contention of the defendant is strongly opposed by the

counsel for plaintiff. Considering the rival submission in the interest of
justice one last opportunity is granted to the defendant to crossexamine
the plaintiff on next date by imposing costs. Accordingly, I pass the
following order.
: ORDER :
1. Notice of Motion No.1197 of 2018 is made absolute in terms
of prayer clause (a)and (b).
2. Defendants are directed to pay the cost of Rs. 3,000/ to the
plaintiff on or before next date.
3. If the defendants failed to crossexamine the plaintiff on
next date, this order shall stands vacated.
