ORAL ORDER
1. This is a notice of motion filed by defendant to set aside no cross
examination order.
2. Heard Ld.advocate Shri.Pandey for defendant at sufficient length.
3. Ld.advocate Shri.K.D.Shah for plaintiff, he strongly resisted the
motion. He contend that defendant is negligent.
4. Considering the age of defendant and grounds mentioned in the
motion, it was fault of then lawyer. Obviously client shall not suffer for
mistake of the lawyer. It would always better to decide the suit on
merit. It is assured to expedite hearing.

5. Accordingly, notice of motion is allowed subject to cost of
Rs.2000/(Rs.Two thousand only) be paid to the plaintiff.
