Heard both sides on CS 764/19. Perused the say given on behalf of defendant no. 2 and 3 on reverse of CS itself. It is submitted by the defendant no. 2 and 3 that appropriate orders may be passed on the CS keeping the contentions of the defendants opened.
Ld. counsel for plaintiff/applicant referred to paragraph no.3 of the affidavit and death certificate of deceased mother of the parties Ahilya Bhimrao Mangalvedhe vide Ex-A and submitted that as per schedule. plaintiff is seeking amendment in the cause tittle deleting name of deceased defendant no. 1 and substitution of 1/3rd undivided share in place of 1/4th undivided shares in respect of right title in the suit property, wherever it occurs in the plaint.
Considering submissions made before the court and death certificate of defendant no. 1, CS no. 764/19 is allowed. Plaintiff shall carry out the amendment within two weeks and submit amended copy of plaint within two weeks thereafter.
