Chamber Summons is taken out by Plaintiff for deleting
name of deceased Defendant no.3 from the plaint. Plff has
filed affidavit in support of Chamber Summons contending
that on 22/03/2019 Defendant no.2 submitted before the
court that Defendant no.3 is expired on 13/01/2019
therefore Plaintiff has taken out this Chamber Summons for
deleting the name of deceased Defendant no.3 from the
suit. Defendant nos.1 and 2 have not filed their reply to the
Chamber Summons. As reported by Defendant no.2
Defendant no.3 is dead since 13/01/2019 and therefore suit
can not proceed against deceased Defendant, hence I find
that Chamber Summons is necessary to be made absolute
for deleting name of deceased Defendant no.3 from the
plaint. Hence, I proceed to pass following order- ORDER 1.
Chamber Summons no.760 of 2019 is made absolute in
terms of prayer clause (a) and (b). 2. Plaintiff is directed to
carry out proposed amendment in the plaint within
stipulated time provided by law. 3. Plaintiff is further
directed to serve the copies of amended plaint upon
Defendants and to file typed copy of amended plaint for the
record of the court. Case is adjourned to 19/03/2020 for
Compliance.
