Adv. Mr. Mirza for the plaintiff is present. He submitted that till
date, the fresh Speaking Order is not received by the plaintiff.
Adv. Mr. Khandagale for defendant/MCGM is present. He made the
statement that still, the Speaking Order is awaited. Here, the
advocate for the plaintiff submitted that accordingly, the matter
may be disposed of.
Order below exhibit No. 01:
The record shows that in view of the Order dtd. 28.08.2020, the
defendant was directed to proceed for fresh Speaking Order after
considering the plaintiff's reply and the plaintiff was called upon to
approach the Court as soon as he receives copy of speaking Order,
which is yet awaited. In the circumstances, the defendant is called
upon to consider the plaintiff's stand and to pass the speaking
Order afresh, as earlier directed by the Court. In case, it goes
against the plaintiff, the effect and operation of the said order may
be stayed for the period of two weeks from the date of its due
communication, to enable him to exercise the remedies legally
available. Consequently, the suit as well as NM No. 1490/2020
stand disposed of and all the pending applications are filed. The
parties to the suit to bear their own costs. Bill of costs be drawnup
accordingly. The proceeding is disposed of.
