ORDER in Ch/sum No. 534/18.1.The applicant Bajrangi Yadav has taken out chamber summons with an affidavit in support for grant of permission to serve notice of motion for restoration of suit to the defendant No.2 by pasting a copy of notice on the main door of the premises of the defendant no.2.
2.The ld. Counsel appearing for applicant has urged that attempts were made to serve notice by R.P.A.D. which returned with postal acknowledgement \''Not Claimed\'' which amounts refusal to accept the service. Substitute service under Order 5 Rule 17 is therefore allowed. Notice be served by pasting on the outer door or some conspicuous part of the premises of the defendant no.2.
3.Chamber summons is accordingly allowed.
