The present suit is of the year 2020. The present NM 1979/25 is filed to set aside an exparte order passed against defendant no. 3 and 4 by order dt. 13/06/2024. It is submitted that, due to personal deficiency alongwith defendant no. 4 they shifted out of Mumbai for education purpose and could not attend the dates. It is submitted that, they are interested to defend the suit and prayed to set aside the order. The application is strongly opposed by the plaintiff and submitted that, defendant no. 3 and 4 were served on 29/09/2020. No grounds are made out to set aside the order. It is further submitted that, matter is protracted and prayed for rejection of the same.
     I have gone through record and it is not in dispute that, due to fault on the part of defendant no. 3 and 4, matter is protracted and the exparte order is passed. It is mentioned that, for education purpose they went out of the town and could not attend the dates. Matter is of the year 2020 and in the interest of justice to give a chance to defend this court is of the view that, opportunity needs to be granted. The matter is protracted hence, no WS order is set aside subject to costs of Rs. 5000/- payable to the plaintiff with directions to file written statement on next date positively, on failure, suitable order will be passed. NM no. 1979/25 is disposed of accordingly.
