        Perused plaint, documents annexed thereto, reply filed by Defts No.3 to 11 and heard bothsides. The Plffs are challenging notice dt.24/1/19 whereby they were requested to carry out structural repairs of the suit building within 6 months. The said letter further reveals that the Plff did not submit structural auditor report in proforma-B and therefore the Deft/MCGM had to accept the report of tenants whereby the suit building was categorized in C2-B. Ld. Adv. for Plff has pointed out that the Plffs have filed structural audit report whereby it was opined that the suit building should be categorized in C-1 category. From the above, if transpires that the report of the Plffs is not considered by Deft/MCGM only on the technical ground that it is not given in proforma-B. Therefore the Plffs are directed to submit their structural audit report in proforma-B to office of Deft/MCGM within four days from today. The concerned officer shall consider such report, if filed within prescribed period and take action in accordance with law.
         The Plffs have also submitted that the tenants are carrying out structural repairs in pursuance of the said notice dt.24/1/19 without obtaining any permission of Deft/MCGM and without consent of the Plffs/landlord.  The Defts No.3 to 11 have submitted the reply to the motion but they have not stated that they have obtained any permission to carry out structural repair.  They have merely stated that they are carrying out repairs as per sec.342 of MMC Act. Therefore they need to be restrained from carrying out any structural repairs to the suit building.  Hence, Defts No.3 to 11 are restrained from carrying out any structural repairs of the suit building till next date.
