This Chamber Summons is taken out by Plaintiff for bringing on record LRs of original Defendant who is reported to be dead as per the letter received by Plaintiff advocate on 15/03/2019 from advocate of original Defendant.
Plaintiff has filed affidavit in support of Chamber Summons. Respondents advocate submitted that respondents have no objection to allow Chamber Summons and respondents are not intending to file reply to the Chamber Summons.
As the Chamber Summons is not resisted and as LRs of original Defendant are necessary to be brought on record, I proceed to pass following order -
                                      ORDER
1. Chamber Summons no.733 of 2019 is made absolute in terms of prayer clause (a) and (b).
2. Plaintiff is directed to carry out proposed amendment in the plaint within stipulated time provided by law.
