ORAL ORDER
1) The chamber summons is filed to serve the
defendant under Order V Rule 20 of the Code of Civil Procedure
by pasting the summons on the door of the address of defendant
shown in the title of the plaint. The chamber summons is
supported by affidavit of Shrenik Voridasji Shah. He on oath
stated that the bailiff could not serve the writ of summons as the
said gala was closed and the name of defendant was not found.
Instead of name of defendant, one poster of “STUDIO” was
affixed on the closed door of gala No. 103. This is the last known
address of defendant. The plaintiff is not knowing the present
address of the defendant. Hence prayed to allow the chamber
summons.

2) The plaintiff has prayed for pasting the writ of
summons to the defendant on the address shown in the title.
Considering the report of bailiff on oath, the defendant is not
residing in the given address and it is stated to have been closed.
Hence the defendant has to be served through paper publication
also. Hence pass following order:
ORDER
1. The Chamber summons is allowed.
2. The plaintiff to serve the writ of
summons to the defendant by pasting
the summons in the address of the
defendant shown in the title and
through paper publication i.e. English
and Marathi widely circulated in the
locality of the defendant.
3. Accordingly, chamber summons is
disposed of.
4. The chamber summons be registered
for statistical purpose.
