The plaintiff No. 1 and 2 are absent. Advocate Shri S. P. Patankar
for defendant stated that both the plaintiffs have expired. The
legal heirs of none of the plaintiffs have appeared to take steps
till date. The issues are framed on 18/04/2022. The roznama
dated 15/11/2022 shows that the death certificate was filed by
advocate for plaintiff that plaintiff No. 1 expired and further
stated that there are no legal heirs of deceased plaintiff No. 1.
Therefore direction was given to plaintiff No. 1 to proceed with
the suit. The advocate for plaintiff stated that the plaintiff No. 2
is not available to adduce evidence. Therefore the suit was
adjourned for evidence to 06/02/2023. The evidence affidavit of
plaintiff No. 2 was filed at Exh.6. The roznama dated
18/09/2024 shows that one of the defendant expired. The death
certificate of defendant No. 2 was filed on 17/10/2024. The
roznama dated 23/12/2025 shows that the advocate for
defendant informed the court that plaintiffs have expired. Hence
the suit is abated.
