Adv. Jamkhandi H/d. Adv. Ashish Phalke for plaintiff present He filed
registered N/M No. 1269/20 and affidavit of service. Adv. Jayesh
Vyas H/d for Diamondwala and Co. for def. no. 3 present. Advocate
Sutar for defendant/BMC present. Plaintiff and def. no. 3 have filed
joint pursis. (Exh2). They submitted that N/M be disposed of in
terms of joint pursis (Exh2). Def. No. 3 has undertaken to pay transit
rent of Rs. 15,000/ per month to plaintiff for period of 6 months and
further agree to pay the aforesaid amount till permanent alternate
accommodation is given to plaintiff if plaintiff is found eligible for the
period after 6 months. Plaintiff has undertaken to hand over
possession of suit premises upon def. 3 paying the aforesaid transit
rent to plaintiff on next date. Therefore Earlier Order shall continue
till next date. In aforesaid terms notice of motion stands disposed of
in view of the oral submission of plaintiff, def. no. 3 and BMC. If any
party to the suit fails to comply till next date, the suffering party is at
liberty to proceed as per law. Because the amount is not paid today,
the def./BMC shall not proceed to evict plaintiff from suit premises
till next date. Both plaintiff and def. no. 3 shall comply on next date
as per their undertaking in Joint pursis Exh2. Accordingly Notion of
Motion No.1269/20 is disposed of.
