ORDER ON C/S NO. 702/2019
By instant C/S plaintiffs have prayed to add technical advisory
committee(TAC) of defendant no.1/MCGM as party to this suit
on the ground that in the affidavit in reply of defendant no.1
to N/M no. 2595/18 the defendant no.1 has raised this point
that the suit is bad for none joinder of TAC as necessary party
to the suit. However, after going through the plaint, the reliefs
are sought against the defendant no.1 /MCGM. TAC is
appointed by defendant no.1 and it works under the latter.
Any order against defendant no.1 would be binding on TAC.
Therefore, TAC did not be added as party to the suit of hence,
C/S is rejected.
Defendant no.4 and 5 have failed to file reply on N/M. Hence,
N/M will be heard without reply of defendant no.4 and 5.
Court busy in hearing in arguments on N/M No. 2925/2017 in
Suit No.1882/2017.
Earlier order, if any, to continue till next date.
Matter is adj. to 06/06/2019 for NM hearing.
