Perused N/m.and the documents filed by MCGM. Heard the officer Mr.Ravindra Ghatge and Ld.advocates of both the sides. Admittedly, the plaintiff has partly complied with the speaking order dated 03.03.2018 by removing unauthorized shed in compulsory open space of Hotel Grand Central on the back side of the building. Which was built up GI Sheets supported by MS Sections ad measuring 9.15 m x 3.60 m.
So far as the second part of the speaking order ie unauthorized constructions in compulsory open space is concerned, the plaintiff has made a statement at Bar that within five weeks from today he shall make an application /proposal for regularization of the alleged unauthorized structure as per the rules of the MCGM. The concerned authority of MCGM to consider the same as per the rules, regulation and Law of the MCGM. The final out come of the said proposal be communicated the plaintiff, till then no coercive action shall be taken by the MCGM. In view of the statements made at bar by the plff as well as the officer of the MCGM, no purpose would be served in keeping the N/m and suit pending. Hence N/m 1180/18 stands disposed of
