Ld. Counsel for defendant no.7 Bank of India makes a statement that
D-3 to 5 have paid the entire loan amount. Ld. Counsel for
defendants no.3 to 5 submits that the mortgage is released by the
bank. He also submits that D-3 to 5 are in possession as owners of
the suit property. In view of these statements the prayer in notice of
motion no.1099/2018 does not survive. Hence notice of motion
no.1099/2018 is disposed of.
Ld. Counsel for defendants no.3 to 5 makes a statement that their
written statement may be treated as reply to NM No.2024/2017.
Statement is accepted.
