present and submitted that Defendant no.9 is not intending
to file Chamber Summons reply. Heard Plaintiffs advocate.
It is submitted that Plaintiff no.1 died on 13/10/2015,
thereafter, all family was disturbed, however Plaintiff no.2
was occupying business of Plaintiff no.1 to support family.
It is further argued that name of Plaintiff no.1 is necessary
to be deleted from the plaint due to death of Plaintiff no.1.
As Plaintiff no.1 is reported to be dead on 13/10/2015,
proceedings of this suit are already abated against said
Plaintiff, hence name of Plaintiff no.1 can be deleted from
plaint by showing that proceedings against him are abated.
Hence, I proceed to pass following order- ORDER 1.
Chamber Summons no.694 of 2019 is made absolute in
terms of prayer clause (a) and (b). 2. Plaintiff are directed to
carry out proposed amendment in the plaint within
stipulated time provided by law. 3. Plaintiffs are further
directed to serve the copies of amended plaint upon
Defendants and to file typed copy of amended plaint for the
record of the court. Case is adjourned to 05/07/2019 for
Compliance.
