Read chamber summons, reply of proposed defendants.
Chamber summons is taken out to implead Pankaj Kanodia and Pooja
Kanodia as party defendant nos.3 and 4 and to incorporate
consequential amendment in relation to them.
It is pertinent to note that as per order dtd.27.03.2019 in Chamber
summons No.684/19 M/s. Grapeviine has been impleaded as party
defendant no.2 and now Plaintiff wants to implead proposed
defendant nos.3 and 4 who are claimed to be partners of said
unregistered firm. In my view in order to avoid any technical defect it
is just to implead respondents as party defendant nos.3 and 4. Moreso,
their presence is necessary to complete adjudication of matter. Hence,
pass following order.
ORDER
1. Chamber summons No.691 of 2019 is allowed and made absolute
in terms of prayer clauses (a) and (b).
2. Plaintiff is directed to carry out amendment within two weeks from
date of order.
Accordingly, chamber summons is disposed off.
